Competition Terms & Conditions

• The “Promoter” of this competition is WIRUlink (Pty) Ltd (“WIRUlink”) (registration number: 2006/011482/07) a Company incorporated in accordance with the Laws of the Republic of South Africa.
• All persons entering (“the entrants”) a WIRUlink Competition ("the Competition") agree to be bound by the competition rules, as set out in these Terms and Conditions.
• The Competition (“Close Date”) is 30 June 2023 and the last day that entries for the Competition will be accepted. The Close Date may be changed by WIRUlink with or without notice at its own discretion.
• The (“Prize”) at the Competition is: a lucky draw to win an EnergyOn 45W and a 60W UltraLAN Micro UPS.
• The (“Sponsor”) for this competition is EnergyOn (Pty) Ltd (“EnergyOn”) (registration number: 2006/039035/07).
• The Prize award date (“Award Date”) is the 7th July 2023. The winners will be notified via a phone call and email, then delivered via courier.

• These terms and conditions as well as the competition rules contain certain terms and conditions which:
  may create a risk or liability for the entrant; and/or may limit the risk or liability of the Promoter or a third party; and/or may compel the entrant to indemnify the Promoter or a third party.
• Nothing in these terms and conditions is intended to, or must be understood to, unlawfully restrict, limit or avoid any rights or obligations, as the case may be, created for either the entrant or the Promoter in terms of the Consumer Protection Act, 68 of 2008 ("the CPA").
• The entrant acknowledges that by submitting his or her entry to the competition he/she has been given an appropriate opportunity to first read these terms and conditions before entering and that he/she understands and agrees to the terms and conditions.
• All entrants to this promotional competition participate entirely at their own risk. By reading and accepting these terms and conditions, the entrant gives consent to these risks and hereby indemnifies and holds harmless the Promoters and WIRUlink, their directors, employees and agents of any and all liability pertaining to any damage, cost, injuries and losses of whatever nature sustained as a result of their participation in the competition and related events and activities, save where such damage, cost, injuries and losses are sustained as a result of the gross negligence or willful misconduct of any indemnified party.
• All participants during the term of this competition agree to be bound by the following terms and conditions which must be read together with other terms and conditions as published on the WIRUlink website as they are applicable, the Debit Order Instruction, the Rental Application, WIRUlink’s Quotation(s), WIRUlink’s Warranty and WIRUlink’s Acceptable Use and Fair Usage Policy (hereinafter referred to as “the Service Contract”).

• The competition period is for 30 (thirty) days, Thursday, 1 June 2023 to Friday 30 June 2023.
• There are two prizes up for grabs: an EnergyOn 45W and a 60W UltraLAN Micro UPS.
• To enter the competition, the participant must sign up for any Vuma Fibre to the Home agreement from WIRUlink.
• The lucky draw will be done on 6 July 2023. The prize will be awarded via courier and the winners will be notified via email and a phone call.
• The participant will only be regarded as an entrant to the competition when the participant has completed a service application for a Vuma Fibre to the Home internet package.
• The prize may only be awarded to the individual who acknowledges it via phone call or email. If the individual does not return communication or fails to acknowledge the prize as theirs, a new name will be drawn.
• Winners may be requested to take part in the Promoter's publicity campaigns or to allow their names and photos to be used by the Promoter for promotional purposes. Winners are, however, entitled to decline such requests.
• The prize may not be exchanged for cash or other prizes or services from WIRUlink or the Sponsor.
• WIRUlink does not offer any warranty or guarantee to the winner of the prize.
• Entering the participant gives WIRUlink permission to collate personal information about the user and utilise it for marketing WIRUlink services. The Participant can opt out of correspondence at any later date.

• the participant must sign up for any Vuma Fibre to the Home agreement from WIRUlink;
• the participant must complete a WIRUlink Vuma Service Application;
• the participant must acknowledge the prize when they have been notified via phone call or email;
• the entrant must be an individual. Juristic entities are excluded from participation;
• The Promoter, their directors, members, partners, employees, agents, representatives or consultants, the suppliers of goods or services in connection with this promotional competition, or any other person who directly or indirectly controls or is controlled by the above-named parties and their respective spouses, life partners, business partners or immediate family members are not permitted to participate in this promotional competition.

• If the winning participant does not answer the phone after multiple attempts or does not reply to the email within 3 days, the participant will forfeit the Prize and WIRUlink may, in its sole discretion, opt to select/draw a new winner.
• In the event of termination of this Competition, all participants agree to waive any rights that they may have in terms of the Competition and acknowledge that they will have no recourse against WIRUlink, its advertising agencies, advisors, suppliers and nominated agents.

• By entering the competition in accordance with its terms, you are entering a promotional competition for the purposes of the Consumer Protection Act, 2008 ("CPA") and the promotional competition will be conducted in accordance with the relevant provisions of the CPA. Should you win a prize in the competition, you undertake to expeditiously do all things necessary to enable the Promoter/sponsor to comply with its obligations under the CPA including, but not limited to (i) providing such personal information as may be required in order to facilitate handing over the prize (including providing proof of address and identity number) and (ii) signing receipt of the prize upon its delivery.
• The names of the prize winners may be published on the WIRUlink website and/or social media platforms.
• Winners may be requested to take part in the Promoter's publicity campaigns or to allow their names and photos to be used by the Promoter for promotional purposes. Winners are, however, entitled to decline such request.
• The Promoter shall conduct the Competition, and the Promoters’ decision on any matter related to the competition, including the selection of the prize winner, is final and no correspondence will be entered into.
• WIRUlink may in its sole discretion amend these terms and conditions or cancel the Competition at any time, without notice, and such amendments the revised terms and conditions may be published on the Promoter’s website. The onus rests on the Entrant to constantly check the website for changes to the terms and conditions.
• The Promoter reserves the right, at any time, to verify the validity of participants (including a participant’s identity, age and place of residence) and to reject any participant who has not agreed to these terms and conditions. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
• If this competition is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorized intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) to modify, suspend, terminate or cancel the competition as appropriate, subject to the approval of relevant regulatory authorities.
• Save as permitted by Law, the Promoter reserves the right to cancel, suspend or terminate this competition, without notice at any time, and may publish this notification and/or amendments on the Promoters website. No liability shall lie against the Promoter in favour of any Entrant and/ or third party arising from such cancellation, suspension or termination. Therefore the Entrants waives his/her rights which they may have against the Promoter and hereby acknowledge that they will have no right of recourse or claim of any nature whatsoever against the Promoter.
• Any dispute or claim arising out of or in connection with the Promotion shall be governed by and construed in accordance with the laws of South Africa.
• To the extent that these terms and conditions conflict with the terms and conditions of WIRUlink service application, the terms and conditions of the latter will take precedence.
• The Promoter accepts no liability or responsibility, whether occasioned by any circumstances not foreseeable and not within its reasonable control for late or delayed delivery of the equipment and/or installation, but not limited to, stock unavailability, strike, lock out, destruction of the equipment on route by any means, any civil commotion or disorder, riot, threat of war, any action taken by governmental authority or public authority of any kind, fire, explosion, storm, flood, earthquake or other acts of God.
• If part or all of any clause of these Terms and conditions is illegal, invalid or unenforceable it will be read down to the extent necessary to ensure that it is not illegal, invalid or unenforceable, but if that is not possible it will be severed from these Terms and conditions and the remaining provisions of these Terms and conditions will continue to have full force and effect.
